Some Business Owners Ramp Up Distaste For ‘Occupy Wall Street’ Protesters

NEW YORK (CBSNewYork) — On Monday, Mayor Michael Bloomberg said “Occupy Wall Street” protesters can stay and have their say as long as they’re law-abiding. In his strongest comments since protesters began occupying lower Manhattan four weeks ago, Mayor Bloomberg made it clear demonstrators can continue to occupy New York City indefinitely, as long as they don’t break the law.

But for some business owners, there’s nothing but outrage. They say the city’s stance on the protest means there is no end in sight to what has rapidly become a living nightmare, reports Brown. “They want to take showers, want to wash up and use the toilet paper to dry up. It becomes … you gotta have one person assigned just to clean the bathrooms,” said Steve Zamfotis, manager of “Charley’s” restaurant.

Zamfotis, who runs a pizza shop directly across the street from Zuccotti Park, said he has to stand guard at the door — just to keep protesters out. “They expect everything, everything for free, nothing to pay,” Zamfotis said.

Meanwhile, the protesters are starting to notice folks taking advantage of the demonstration by grabbing some of the free food and clothes that have been made available in Zuccotti Park. “The tourists take all the food, and the hipsters take all the clothes,” said one demonstrator.

But other businesses are opening their doors — in a show of solidarity. “Oh no problem. We let them use the bathroom because all the fancy places close the bathrooms for them. Yeah, we leave it open. It’s too much, but what are you gonna do? Everybody has right to use the bathrooms,” said Alfonso Alfi, manager of “Pronto Pizza.” The private firm that owns Zuccotti Park said it hasn’t been able to clean the park since Sept. 16 and sanitary conditions have become unacceptable.

In a statement the firm said it is working with the city to restore the park to its intended use, but on Monday — from the mayor to the NYPD Commissioner Ray Kelly — city brass said they can’t — and won’t — force a stop to this anytime soon. “As long as people obey the law we’re not stepping in at all,” Kelly said.

Also Monday, a few celebrities stopped by Zuccotti Park to lend their support. The Rev. Al Sharpton was scheduled to broadcast his nationally syndicated radio show “Keepin’ It Real” from Zuccotti Park on Monday. Media mogul Russell Simmons and actress Susan Sarandon visited the park on Monday. Sarandon told 1010 WINS’ Stan Brooks, ”This is what democracy looks like … it’s great that anybody cares enough. I’m surprised people weren’t in the street a year ago. I think it’s fabulous.”

Also, a video on YouTube has surfaced showing Jimmy “The Rent Is Too Damn High” McMillan playing guitar and singing a song for the protesters.

In other protest news, a YouTube video, purportedly by the hacker collective known as “Anonymous,” threatened to wipe out the New York Stock Exchange website Monday. However, a message on a YouTube video suggests that the entirety of the the hacker collective does not support the attempt to disable the website. It says some factions of it are going to press forward with the effort.

A company that monitors website response times says The NYSE’s website was hobbled twice Monday, possibly the result of computer attacks. A San Mateo-based company called Keynote Systems Inc. said the NYSE website experienced a one-minute outage around 3:30 p.m. Eastern, then a half-hour outage about two hours later. NYSE spokesman Ray Pellecchia said an investigation by the stock exchange showed no disruptions to its website.

President Obey-Me Is Not Being Obeyed

Rejection is no fun, especially if you're a heavenly rock star with a savior complex.  When people with narcissistic personalities come into psychotherapy, they often complain that nobody loves them -- and they can't understand it, because aren't they just the most lovable fluffy dolls in the world?

This is not Harry Truman.  It's not Herman Cain.  It's a guy who loves being worshiped, and he can't accept it when the crowds stop cheering. Narcissists are not nice.  They treat others as puppets on strings.  The rest of us get  drawn in by their superficial charm, and then, after a while, we figure out that we've been had.  As soon as we walk away, the result is a towering rage by the narcissist.  We all know people like that.

This is all routine psychiatric manual stuff.

If you can handle a little more, President Obama is an interesting mix of narcissism and "Oppositional Defiant Disorder."  No other president in history has actually given his fellow Americans the fickle finger of fate in public, to the cheers and applause of his own followers.  This is not  Thomas Jefferson or Abe Lincoln.  This is immature kid stuff.

So here we are.  Our moronic MedioCrats have gotten America stuck with a man who was never tested by adversity.  Unlike Herman Cain, Sarah Palin, Michele Bachmann, and the other GOP candidates, he isn't used to scraping his knees on the playground and then just going "pick yourself up, dust yourself off, start all over again."

Fred Astaire and Ginger Rogers sang "Pick yourself up" in the 1936 hit Swing Time (Jerome Kern and Dorothy Fielding).  That was in the depth of the Great Depression.  "Pick yourself up" is the song of ordinary Americans who tackle the hard jobs, which is why it was so popular.  It's still a great song.

America doesn't sing "Pick yourself up" anymore.  All we sing is "I'm a victim!  My parents don't love me!  I don't want to pick myself up, dust myself off, and start all over again!  Help me!  Give me free money!"  Tens of millions of kids have been raised by moms without dads, and they are mommified -- they expect fulsome flattery just to get out of bed in the morning.

If you doubt that, check out the photos of thousands of rich kids with Apple iPads sitting on Wall Street, trying to figure out what they're supposed to be protesting.  The "Days of Rage" are really the "days of narcissistic rage."  These kids are as phony and self-indulgent as the Obey-Me administration.  If you don't adore them for giving us the finger, there is something wrong with you.  And why aren't you paying for their health care for the rest of their lives?

According to Michael Goodwin in the New York Post:

I have heard basically the same story four times in the last 10 days, and the people doing the talking are in New York and Washington and are spread across the political spectrum.
The gist is this: President Obama has become a lone wolf, a stranger to his own government. He talks mostly, and sometimes only, to friend and adviser Valerie Jarrett and to David Axelrod, his political strategist.

Everybody else, including members of his Cabinet, have little face time with him except for brief meetings that serve as photo ops. Secretary of State Hillary Rodham Clinton and Treasury Secretary Tim Geithner both have complained ... that they are shut out of important decisions.

The president's workdays are said to end early, often at 4 p.m. He usually has dinner in the family residence with his wife and daughters, then retreats to a private office. One person said he takes a stack of briefing books. Others aren't sure what he does.

If the reports are accurate, and I believe they are, they paint a picture of an isolated man trapped in a collapsing presidency."

Before saying anything else, please do not forget who sold us this immature Napoleon Bonaparte.  It was the power clique of the left, the Democrats and the media, who are just different faces of the same beast.  Obama's rage and withdrawal into his private cult was predictable in 2008 and in 2004, when he rocketed to stardom with his Democratic Convention speech.  Narcissists are incredibly stuck and predictable -- unless they've been honed and polished by difficult life experiences, that is.  If the MedioCrats couldn't spot Obama as a grossly immature, utterly self-centered individual, it is because he reflected their own psychology.  It was a hall of mirrors.

We are therefore seeing not just Obama himself.  If you look at the over-the-top rage and self-regard of the radical left, they are all little Obamas.  Paul Krugman is just another Obama, ranting in his little corner of the NYT op-ed page.  George Soros has written (in his autobiography) about his own grandiosity. 

Hugo Chávez expressed outrage at the "horrible repression" of those thousands of kids camping out overnight on Wall Street, and El Jefe Hugo is just another Obama.  He is a generalissimo of the left, like Castro and Putin, Marx, Lenin and Stalin, the whole panoply of towering egos.  Malignant narcissism and self-glorification is the mass neurosis of the radical Left.

If you doubt that the "Rage" campers are like that, just listen to their rhetoric.  They are "progressives," which means they are way ahead of everybody else.  Progressive is a new name for "vanguard of the revolution," the preferred piece of self-flattery until the Soviet Union fell apart.

The left has seen a century of murderous failures by the radical left, and they still don't get the point.  They are stuck on stupid, as General Russell Honore said during Hurricane Katrina.  Mental fixedness is another marker of the extremist left.  Like Woody Allen in Sleeper, slipping on the same giant banana peel over and over again, they can't get out of their own mental traps.

This stuff is all part of the human condition, and it's been around since King Herod the Great and Oedipus Rex.  The trouble is when a truly immature narcissist, surrounded by his own tiny inner cult, gets elected to the highest office in the land.  Americans have never been dumb enough to do that, though they came close with Woodrow Wilson and FDR.

This time we, the American people, have really blown it. The result is dangerous.  It's not just the incompetence, fraud, and  mismanagement, though those are bad enough.  What we are facing today is genuine danger to our national security and welfare. That's the most troubling fact to see, but I'll bet that in major capitals around the world, it is beginning to hit home.  If we can see it, you can bet that others -- intelligence agencies and power-mongers around the world -- see the same things.

They will try to exploit our weak and fragile president as much as they can.

Is Barack a Petrified Political Fetus?

Barack is in worse shape than a fetal pig in a jar, turned rubbery brown after years of immersion and sunlight. You see, he’s a PPF—a Petrified Political Fetus. He’s all done, but never begun. He decided to skip his chance to be a leader so he could roll out his “community organizer” schtick. Obama is both bored and frankly disgusted by the thought of leading America the Ugly. So he frankly decided he’d rather not, and call it a day. Permanently.

It would seem that Barack is ready to join a long list of frauds who achieved prominence after juking and jiving their way to success. One infamous role-model fraud will be examined—Count St. Germain. But it is terribly sad at a time of extreme crisis around the world, where so many lives hang in the balance, that a ridiculous poseur would take the place of a trained leader to aggrandize himself. This is the subject of this essay.

I. Petrification of Political Fetus Obama

How badly has Barack muffed his presidency? Well, let’s put it this way…if Barack were a plate juggler at a Chinese circus, there would be so much pottery on the floor the audience would have to assume it was a Greek wedding. Obama has screwed up every decision, when not assuming the posture of the previous administration. Of course, we can give him a pass on the killing of Osama bin Laden and still not murder our premise that Barack is no leader, whatsoever.

It has become a truism of even leftist political analysis that bamboozler Barack is waaaaay over his head as leader of the free world. In fact, he’d probably be at wits end running the camera department at the local Walgreens. But consider the following recent body slams our boy king has endured from the faithful.

Tina Brown, doyenne of leftist publishers, recently said...

But if he (Barack) doesn’t feel ready to run- Actually, I just hope he doesn’t, because in the end, you know, his tremendous misgivings, maybe he is right. I mean, We had this with Obama. He wasn’t ready, it turns out, really.

First Black American billionaire, Democrat Robert Johnson, founder of Black Entertainment Television (BET) recently criticized Barack’s Buffet Rules, saying,

I think the president has to recalibrate his message. You don’t get people to like you by attacking them or demeaning their success..By attacking me, Obama is not going to convince me that I should take a bigger tax hit because I happen to be wealthy.

Democrat Senator Webb criticized Barack’s plan to hike taxes: “I do not believe we should be increasing ordinary earned income taxes on any level.” But it may have been his recent decision to not offer a budget plan, then admit it—during the recent budget standoff—that cemented his reputation as the “Leading From Behind” politician. In fact, he couldn’t lead a group of chickens away from a fox’s den.

II. Barack’s Cargo Cult Presidency

Obama’s presidency resembles a Cargo Cult in that it is designed to look like wise policy and leadership, but underneath is a crazy, mindless replica which can only hope to fail. Cargo Cults are groups of primitive tribes who, after they were visited by modern man who flew in goods via planes, thought they could get the airmen to return by building primitive grass-planes as an act of worship.

Physicist Richard Feynman wrote about a type of thinking which is exactly the same as the basic premises of this belief. Sir James Frazier in his immortal Golden Bough wrote this type of thinking was characteristic of primitive man, calling it Sympathetic Magic.

Feynman wrote in his article Cargo Cult Science,

In the South Seas there is a cargo cult of people. During the war they saw airplanes land with lots of good materials, and they want the same thing to happen now. So they’ve arranged to imitate things like runways, to put fires along the sides of the runways, to make a wooden hut for a man to sit in, with two wooden pieces on his head like headphones and bars of bamboo sticking out like antennas‚Äîhe’s the controller—and they wait for the airplanes to land.

They’re doing everything right. The form is perfect. It looks exactly the way it looked before. But it doesn’t work. No airplanes land. So I call these things cargo cult science, because they follow all the apparent precepts and forms of scientific investigation, but they’re missing something essential, because the planes don’t land.

Feynman describes what is missing in this thinking:

But there is one feature I notice that is generally missing in cargo cult science…It’s a kind of scientific integrity, a principle of scientific thought that corresponds to a kind of utter honesty…

But the metaphor of Cargo Cults and their faux designs can also apply to politics. In fact, Randall Hoven describes this in Cargo Cult President. He writes of Barack,

He is the Cargo Cult President. At least the real Cargo Cult followers built real things that looked like landing strips to get airplanes loaded with food and supplies to land on them. Obama thinks you get factories to produce things and hospitals to fix people by making speeches—speeches that are reasonably good imitations of speeches given by real leaders.

Overall, consider how Obama leads a fake administration that cannot—either by talent, or evil design—do the most basic things to make America work. Therefore we are caught in a situation that increasingly looks like another Great Depression, directed by a man who apparently believes he can “Lead From Behind” while our country breaks down all around, in his wake.

And all Obama thinks he needs to do is put out faux policies, like “Stimulus” economics, or “Arab Spring” foreign policy, or “Tax the Rich” fiscal policy, etc. And all because Obama pretended to know the science of leadership,despite no experience, and leftist dupes across America bought his con act. But imagine if people had not propped up Obama his whole life and allowed him to move ahead even though he wasn’t qualified—what a different situation we’d be in right now!

III. Obama Role Model: Claude Louis, Comte de Saint-Germain

Eighteenth century Saint Germain, who claimed to be 300 years old, was one of the most famous frauds in history, vibrantly reminiscent of Obama. Writes biographer Isabel Cooper-Oakley,

The original ‘International Man of Mystery,’ the Count St. Germain, was an 18th century European aristocrat of unknown origin. He had no visible means of support, but no lack of resources, and moved in high social circles. He was a renowned conversationalist and a skilled musician. He dropped hints that he was centuries old and could grow diamonds. He never ate in public, was ambidextrous, and as far as anyone could tell, totally celibate.

Oakley mentions further claims made by Saint-Germain:

He always appeared about forty years old, popped up from time to time after his official death, made spot-on, unambiguous prophecies, could transmute matter, and spontaneously teleported to distant locations.

Saint Germain was supposed to be the greatest alchemist of his age and also wrote important works on the occult. He also loved to boast. Another biographer of the Count says when he overheard a topic he felt himself the unmitigated expert on, he could not restrain his contempt:

Said Gleichen of the first time he met Saint-Germain: “He threw down his hat and sword, sat down in an armchair near the fire and interrupted the conversation by saying to the man who was speaking: ‘You do not know what you are saying! I am the only person who is competent to speak on this subject, and I have exhausted it. It was the same with music, which I gave up when I found I had no more to learn.’”

While the Count’s claims seem silly stuff in a scientific age, are they really any more nonsensical than Obama stating that if he is elected, that the earth will begin to heal itself, the polar caps stop melting, and the seas lowered? Perhaps Barack is no more deluded than Saint-Germain when he allowed others to constantly describe him as the smartest man to ever occupy the White House, or as one who needed no practical experience in assembling a budget, running the world’s largest bureaucracy, or in conducting foreign affairs.

The Saint’s megalomania is reminiscent of Obama bragging about himself to a job interviewer looking for White House work:

I think that I’m a better speechwriter than my speechwriters. I know more about policies on any particular issue than my policy directors. And I’ll tell you right now that I’m gonna think I’m a better political director than my political director.

In fact, if one were to put together Saint Germain, Paris Hilton, and Peer Gynt, then adding a touch of Martin Luther King’s wily, borrowed rhetoric, one might begin to understand the terrible peril America currently labors under.

IV. The Obama Follies Will End In Tears

One of the most remarkable acts of journalism in the wake of Barack’s election is found in an article by Scotsman Gerald Warner, titled “Barack Obama inauguration: this Emperor has no clothes, it will all end in tears.” On a day when another article ominously asks, “Is US Economy Flirting With ‘Modern-Day Depression’?”—a few excerpts are apropos here:

This will end in tears. The Obama hysteria is not merely embarrassing to witness, it is itself contributory to the scale of the disaster that is coming. What we are experiencing, in the deepening days of a global depression, is the desperate suspension of disbelief by people of intelligence—la trahison des clercs—in a pathetic effort to hypnotise themselves into the delusion that it will be all right on the night. It will not be all right.

It is frightening to think there is a real possibility the entire world economy could go into complete meltdown and famine kill millions. It is questionable whether the present political system can survive the coming crisis. Whatever the solution, teenage swooning sentimentality over a celebrity cult has no part in it. The most powerful nation on earth is confronting its worst economic crisis under the leadership of its most extremely liberal politician, who has virtually no experience of federal politics. That is not an opportunity but a catastrophe.

These are frank, even ungracious, words: they have the one merit that, unlike almost everything else written today about Obama, they will not require to be eaten in the future.

Conclusion

Doubtless Barack is over his head as president, in every measure of the concept. Whether he employs this as a plan to topple America from greatness—as some claim, or that he is simply an incompetent nincompoop, too selfish and irresponsible to care the damage he does—is now irrelevant. But it is important to understand that Barack never rose to the challenge of becoming a great leader—as many prophesied of him—or even a competent one. Instead, he simply crumpled to the ground, clutching his knees while morphing into a human fetal fossil, never having grown a metaphorical inch before quitting. Therefore, he really is a person who parachuted into his position—to use Pelosi’s metaphor—who has no natural ability to do anything required for leadership, save read a sandwich board.

Obama has clearly drunk deep of socialist and Marxist philosophy during his life which he admitted to Joe the Plumber and others that he really believes. If the goal of any self-respecting socialist is to foment revolution in any manner possible to bring about a Marxist state—Who are we to refuse to believe his sincerity when his actions seem to inevitably lead to socialist sabotage over any other possible theory?

I walked down the street in Barcelona , and suddenly discovered a terrible truth - Europe died in Auschwitz ... We killed six million Jews and replaced them with 20 million Muslims. In Auschwitz we burned a culture, thought, creativity, talent. We destroyed the chosen people, truly chosen, because they produced great and wonderful people who changed the world.

The contribution of this people is felt in all areas of life: science, art, international trade, and above all, as the conscience of the world. These are the people we burned.

And under the pretense of tolerance, and because we wanted to prove to ourselves that we were cured of the disease of racism, we opened our gates to 20 million Muslims, who brought us stupidity and ignorance, religious extremism and lack of tolerance, crime and poverty, due to an unwillingness to work and support their families with pride.

They have blown up our trains and turned our beautiful Spanish cities into the third world, drowning in filth and crime. Shut up in the apartments they receive free from the government, they plan the murder and destruction of their naive hosts. And thus, in our misery, we have exchanged culture for fanatical hatred, creative skill for destructive skill, intelligence for backwardness and superstition.

We have exchanged the pursuit of peace of the Jews of Europe and their talent for a better future for their children, their determined clinging to life because life is holy, for those who pursue death, for people consumed by the desire for death for themselves and others, for our children and theirs.

What a terrible mistake was made by miserable Europe.

The Jews are NOT promoting brain washing children in military training camps, teaching them how to blow themselves up and cause maximum deaths of Jews and other non Muslims. General Eisenhower Warned Us. It is a matter of history that when the Supreme Commander of the Allied Forces, General Dwight Eisenhower, found the victims of the death camps he ordered all possible photographs to be taken, and for the German people from surrounding villages to be ushered through the camps and even made to bury the dead.

He did this because he said, in effect:

Recently, the UK debated whether to remove The Holocaust from its school curriculum because it ' offends ' the Muslim population which claims it never occurred. It is not removed as yet. However, this is a frightening portent of the fear that is gripping the world and how easily each country is giving into it.

It is now more than 60 years after the Second World War in Europe ended. This e-mail is being sent as a memorial chain, in memory of the, 6 million Jews, 20 million Russians, 10 million Christians, and 1,900 Catholic priests who were ' murdered, raped, burned, starved, beaten, experimented on and humiliated ' while the German people looked the other way.

Now, more than ever, with Iran , among others, claiming the Holocaust to be  'a myth', it is imperative to make sure the world never forgets. How many years will it be before the attack on the World Trade Center  'NEVER HAPPENED' because it offends some Muslim in the United States?

As she travels for the last time on this earth to see her mother, let her know that this is not the last time she will see her--they will be together always, as G*d intended.

Hikergal has given her mother a wonderful, large successful family--the bedrock of her world will be the bedrock of her heaven.

Though you will miss her corporeal being on earth, she will still be here; just hike the lovely trails you hike and you will find her everywhere.

Talk to her. She is there already! ;-)

I guess everyone will have to post here if they wish to talk to me; Gerty, EscapedCommieNY and Yottyhere etc. flagged enough of my perfectly decent posts, so I can't post at Lucianne anymore. Please pray for them...and anyone else they got to join in. I suggest anyone on the Connection be very careful in posting to these gals; if they decide to mind what you say, they will conspire to have you removed--and it will happen. I'd love to be able to tell them that they made the last days of my life absolutely terrible--and so many more ugly things... for Sissy, too... I don't have much time left.

Please tell Magdalene, Jen, Nu, Charzi/Mrs. Cow that I wish to include them in my thoughts and prayers, but they'll need to come over here to share in them.

I have lost most of my ability to walk, so I need other places to post to keep in touch with the outside world--2-3 hrs. a day with an exhausted sister is not enough; I send her to bed as soon as I can... 22 hrs. a day alone feels like I'm already dead. Any suggestion for sites that are nice and easy to use, let me know. We are not doing well, and I have nowhere to go--mentally or physically. I'm sorry for that. I really just can't do this anymore..

Obama’s Premeditated Murder of America

Why is no one stepping forward to halt the murder of America? As surely as the Bolsheviks murdered the Romanov family at Ekateringburg on July 17, 1918, Barack Obama and his handlers are murdering America. Why is no elected official stepping forward to halt the murder of America; the assassination of 300 million lifestyles, not even counting the untold millions of freedom lovers who depend on the USA worldwide? It is now crystal clear that Obama is pushing America into the certainty of a socialist state.

Pretending it isn’t happening is not doing anything to stop the greatest nation ever paid for in blood and sacrifice from disappearing forever from a predator weary world. It is patently clear that Obama is as much “your agent of change” as Raila Odinga, the despot he actively campaigned for one year before he ran for his own presidential election in 2008. This Nobody in any kind of worthwhile stature is deliberately trying to scrub America’s noble history from the books; is erasing in big swipes off the chalkboard,  American exceptionalism that for centuries made life better for so many in other corners of the world.

Even dreamers know that a Ronald Reagan only come along once in a lifetime, but where are the statesmen of the day decrying loudly against the deliberate decline of America? Did striving to save America from the political front die off in 2007 with Congressman Henry Hyde? Sen. Hyde, who served in the Navy during WW 11, where he served in combat in the Philippines, was the congressman known for his leadership role in managing the impeachment trial of President Bill Clinton. Did the dream of a better day die with the passionate pleas of Martin Luther King?

The American Space Race that kindled the imaginations of youngsters everywhere   ended with the grounding of the Space Shuttle.  The Space Shuttle didn’t die a natural death but was willfully killed off by Obama in July,  2011.  The Constitution is in tatters;  American patriots are shunned by a regime-complicit mainstream media and are held back from the fight to save their country by a president whose minions, many of them appointed and not elected, get to smear them as “terrorists”.

Even as this is being written, Obama’s barbarians at the gate, being fed on site three square meals a day, while out in the streets calling for anarchy at the expanding Wall Street protests. Obama can choose from any one of his running dog alphabet networks to grab headlines,  as he did again only today demanding the passage of a “jobs bill” which is, in reality,  just another tax bill.

The screams are already renting the air with House Speaker John Boehner concluding “We’re legislating.  He’s campaigning.  It’s very disappointing.” What Obama is doing to America transcends disappointment, Mr. Boehner.  It’s premeditated murder. And most tragic of all, the life is being squeezed from America with no elected voice—not even one—calling out loudly to save her.

My Thoughts On Amanda Knox:

Several years ago, when Britney Spears’ meltdown was at its peak and couldn’t be avoided in the news, I did the shortest post in the history of the blogosphere. I titled it “My Thoughts On Britney Spears,” and the body of the post was blank.

Surprisingly, perhaps, I do have some thoughts on today’s verdict in Perugia acquitting Amanda Knox and her “boyfriend” of less than a week, Raffaele Sollecito. The story was simply irresistible, especially to a lawyer. I started reading up on it and, as it happens, I do have a strong opinion on the case. So here goes.

I think the conviction of Knox and Sollecito was an outrageous miscarriage of justice, driven by preoccupations on the part of the prosecutor, and maybe some policemen, that can only be described as medieval. There was no meaningful evidence against them. None. And–this is a fact that is often lost sight of–we actually know who killed Meredith Kercher. It was Rudy Guede.

Let me amend that. We know for sure that Guede raped Kercher, based on DNA evidence that, as far as I know, is undisputed. Beyond that, Guede’s DNA was all over the room where Kercher was killed, whereas DNA from both Knox and Sollecito was conspicuously absent. Now, it is possible that Guede raped Kercher, then vacated the premises, and someone else came along and killed her. But let’s apply Occam’s razor: it is virtually certain that whoever raped Kercher also killed her. So, where lies the mystery? The murderer has been identified. Moreover, Guede fled to Germany after the murder and called a friend, whom he told, among other things, that Knox was not in the house on the night of the killing. The evidence against Guede evidently was conclusive, and he was long ago tried, found guilty and sentenced.

This is where it gets medieval. Someone–I think the prosecutor–spun what can only be described as a fantasy. Not satisfied with Guede as the murderer, he imagined that Amanda Knox may have inspired the crime. He pictured a “sex game gone wrong,” featuring Guede, Sollecito, Knox and Kercher. Pause on that for a moment: Knox had known Sollecito for a mere six days at the time of the murder, and barely was acquainted with Guede. Sollecito had never met Guede. If you think it likely that that trio would have engaged in a “sex game” that turned into a murder, you move in circles very different from mine. Of course, the prosecutor speculated that the sex game was “drug fueled.” What was the evidence of drugs? The same as the evidence for group sex: zero. The prosecutor made it up.

The most bizarre aspect of this miscarriage of justice, perhaps, was that Guede’s sentence was reduced to 16 years, while Knox was sentenced to 26 years and Sollecito–the forgotten man of the story, who must wonder more than anyone what he did to be trapped in such a nightmare–got 25 years. How on earth did the prosecution justify this focus on Knox and Sollecito, in preference to the man whose DNA showed that he (and he alone) had raped Kercher? Simple: Knox was a “she devil,” whereas Guede was merely her tool–seriously! The evidence for this claim? There wasn’t any. This kind of fantasy is inconceivable in a modern court.

There were two types of evidence against Knox and Sollecito. The key evidence in the original trial was a knife that belonged to Sollecito. That knife had Knox’s DNA on the handle–no surprise there–and, allegedly, Kercher’s DNA on the blade. This and the bra clasp discussed below were the only things that ostensibly tied Sollecito to the crime. But there were huge technical issues with the tiny amount of DNA allegedly found on the blade, and the knife didn’t match either the bloody outline of a knife on Kercher’s bedspread or the wounds in Kercher’s neck.

Then there was the claim that a minute amount of Sollecito’s DNA was found on a clasp from Kercher’s bra. Unfortunately, the clasp wasn’t discovered until six weeks after the murder, lying on the floor of Kercher’s bedroom. The technical handling of all of this evidence by the Perugia police was appalling, and independent, court-appointed experts blew away the supposed DNA evidence in the appellate trial that was just concluded.

The second type of evidence against Knox–it didn’t really apply to Sollecito–had to do with her statements and behavior after the murder. Knox first drew the suspicion of Perugia’s police force when she turned cartwheels while waiting to be questioned after the murder was discovered. Kercher’s other friends were in tears, but Knox was turning cartwheels–the police found this suspicious, but some would say that while such behavior may be inappropriate, it is more consistent with knowledge of innocence than guilt. And does this remind anyone else of The Stranger, where the focus of the prosecution is not on what the defendant did, but on the odd way in which he reacted to his own mother’s death?

Knox made several odd statements to Perugia’s finest; she implicated a bar owner named Lumumba (no relation to Patrice, I assume) and talked about being in the house and hearing Kercher scream. But all of this was after 56 hours of questioning by the Italian police, with no lawyer present and only a dubious translator (at this time, Knox’s Italian was not as fluent as it is now, after four years in prison in Perugia.) 56 hours of non-stop questioning? That would never happen at Guantanamo Bay, and Knox was a 20 year old girl in a foreign country. I’ve heard it said that these musings were in response to a policeman’s asking Knox to imagine how the crime might have happened, but I haven’t seen a transcript (if one exists) to verify whether that is correct. In any event, Knox and Sollecito have consistently maintained their innocence. Is anything that Knox said sufficient to convict her, or anyone else, of murder? Certainly not.

In the end, the prosecution of Knox and Sollecito seems to tell us more about the prosecutor’s twisted psyche than about those defendants. The fact that Italian authorities were willing to let off the one man who they knew committed the crime more easily than the two fantasy defendants shows how twisted the criminal process became. Injustice can happen anywhere, but it is hard to imagine Knox and Sollecito, represented by competent defense counsel, being convicted in any American court. So I was happy to see them exonerated.

Obama Seeks Debt Collector Proposal

To the dismay of consumer groups and the discomfort of Democrats, President Barack Obama wants Congress to make it easier for private debt collectors to call the cellphones of consumers delinquent on student loans and other billions owed the federal government.

 

The change "is expected to provide substantial increases in collections, particularly as an increasing share of households no longer have landlines and rely instead on cellphones," the administration wrote recently. The little-noticed recommendation would apply only to cases in which money is owed the government, and is tucked into the mammoth $3 trillion deficit-reduction plan the president submitted to Congress.

 

Despite the claim, the administration has not yet developed an estimate of how much the government would collect, and critics reject the logic behind the recommendation.

 

"Enabling robo-calls (to cellphones) is just going to lead to more harassment and abuse, and it's not going to help the government collect more money," said Lauren Saunders of the Boston-based National Consumer Law Center. "People aren't paying their student loans because they can't find a job."...
